McArthur, Dellacona Team Wins $9.2M Med-Mal Verdict

$9.2 million | Verdict

Date: January, 2023
Medical Malpractice
Bibb County State Court

The McArthur and Dellacona law firms secured a $9.2 million wrongful death verdict in a Bibb County medical malpractice case. The case involved the death of Allen Turner, who underwent a complicated surgery at Atrium Health Navicent Medical Center, during which surgeons mistakenly severed a major artery, leading to his death. The jury found that the doctors and the hospital were responsible for the majority of the damages. The defense argued that the surgeons provided exemplary care under difficult circumstances, but the jury sided with the plaintiffs, led by attorneys Tracey Dellacona and Katherine McArthur. Despite challenges in presenting complex medical details, the plaintiffs effectively argued that inadequate preparation and surgical errors led to Turner’s death.

Curtis McGhee and Denise McGhee v. John Ryan Jr.

$817,000 | Verdict

Date: January 25, 2019
Auto Insurance Policy
State Court of Bibb County

Macon lawyer Katherine McArthur secured an $817,500 verdict for her client, Curtis McGhee, following a car crash that led to significant back and hip injuries. Despite a pretrial settlement offer from the defense of only $125,000, McArthur successfully argued that McGhee’s injuries were caused by the crash and not by pre-existing conditions like disc degeneration or arthritis, as the defense claimed. The jury awarded substantial amounts for medical expenses, pain and suffering, lost income, and loss of consortium. McArthur plans to seek full recovery, including interest and attorney fees, due to the $1 million in excess coverage available.

Gwinnett Jury Awards Woman $3.1M for Delayed Spine Diagnosis

$3.1 million | Verdict

Date: June, 2017
Medical Malpractice
Gwinnett County

Nicole Hill, a 33-year-old certified nursing assistant, was awarded over $3.1 million by a Gwinnett County jury after an emergency room doctor failed to promptly diagnose and treat her ruptured disk, leading to permanent incontinence and mobility issues. The original verdict was for $5.2 million, but 40% of the liability was apportioned to Hill. Hill, who weighed 435 pounds at the time, faced discrimination due to her weight and lack of insurance, which plaintiffs’ attorney Katherine McArthur argued contributed to the inadequate medical care. Despite multiple ER visits, the doctor did not order an MRI, which delayed treatment and worsened her condition. The case involved several defendants, but by the trial, only Dr. Jose Gumarin and his employer, EmCare Inc., remained after others settled.

Hewlett v. Brown

$15 million | Verdict

Date: April 12, 2013
Wrongful Death
Fulton County Court

A Fulton County jury awarded over $15 million to the parents of Kaleo Hewlett, a 22-year-old man killed in a car crash involving a speeding pharmaceutical sales representative from AstraZeneca with a history of traffic offenses. The verdict included $10 million for the value of Hewlett’s life and $5 million for his pain and suffering. The crash occurred in 2008 when Hewlett was riding in a car that was rear-ended by the speeding AstraZeneca rep, Richard Brown, who had a record of 15 speeding tickets. Brown had admitted liability before the trial, and AstraZeneca argued that since Brown was off-duty at the time, the company should not be held liable.

The jury disagreed, finding AstraZeneca negligent for allowing Brown to drive a company car despite his dangerous driving history. The verdict also included punitive damages, with the final judgment amounting to $15.26 million.

Ford v. McGrogan

$5.2 million | Settlement

Date: March 10, 2008
Auto Accident

Our client, Georgia woman Debra Ford, received a $5.2 million settlement after being injured in a car accident caused by an International Paper Co. employee who was using a company cellphone while driving. The plaintiff’s attorney, Katherine McArthur, successfully argued that the defendant’s use of the cellphone was “unreasonable” under Georgia law, and the company’s ownership of both the car and the phone made them liable for the damages. Ford’s injuries were severe, requiring multiple surgeries that ultimately led to the amputation of her arm. Although there was debate about whether the defendant was on the phone at the time of the accident, the plaintiff’s case was strengthened by research showing that cellphone use impairs drivers more than alcohol. The settlement was reached before trial, with the company potentially facing much higher damages had the case gone to court.

Testimonial:

“What happened to bring me to Miss Kathy was in 2005 I was rear-ended on the interstate, on I16 in Laurens County, by a girl text messaging and lost my left arm. I felt like Miss Kathy really cared, her and her staff. She doesn’t act like a lawyer when you visit with her. I mean she treats you like family. She kept me informed and updated on everything that went on. Miss Kathy absolutely fought for me and I would recommend her to anybody.”

Danny Webb

$19 million | Verdict

Date: March, 1991
Trucking Accident / Explosion
Fulton County Superior Court

Macon lawyers Katherine L. McArthur and W. Carl Reynolds won a $19 million verdict for their client, Danny Webb, who was paralyzed and brain-damaged by an exploding tire rim. Despite a $7.5 million settlement offer after the jury cleared Webb and his employer of causing the explosion, the lawyers gambled on a higher award and succeeded. The verdict included $10.3 million in compensatory damages and $8 million in punitive damages against Firestone Tire & Rubber Co., one of the three defendants. The lawsuit claimed that the tire rim had a design defect, and the defendants failed to warn consumers about the dangers, which led to Webb’s severe injuries. The defendants are considering appeals, but the jury found Firestone 65% responsible, General Motors 25%, and Kelsey-Hayes 10% after determining they knew about the risk of such explosions.
