Car Accidents – Car accidents can result in serious injury and even death. Even smaller accidents can induce whiplash and back injuries, not to mention the actual damage to the involved cars. Fortunately, state law requires all drivers to carry a minimum amount of insurance – unfortunately, not everyone follows this law, and most insurance companies try to fight claims. Spinal Cord Injury – Spinal cord injuries are often debilitating. From smaller back pain to paralysis, these injuries must be treated fully and immediately. Spinal injuries are common after serious motor vehicle accidents, slip and fall accidents, and acts of violence like a stabbing or gunshot.

What About Compensation?

Specific Damages

Specific damages, also known as economic damages, cover the direct financial losses you incur as a result of your injury. These are quantifiable expenses that can be documented and proven with bills, receipts, and pay stubs. Some common examples of specific damages include:

Medical Expenses: This includes all costs associated with your medical treatment, such as hospital bills, surgery costs, prescription medications, physical therapy, and any future medical care you may require.

Lost Wages: If your injury has caused you to miss work, you are entitled to recover the income you have lost during your recovery period. This can also extend to a loss of earning capacity if your injury affects your ability to work in the future.

Property Damage: If your personal property, such as your car, was damaged in the incident that caused your injury, specific damages would cover the cost of repairs or replacement.

Rehabilitation and Therapy Costs: This includes expenses for any ongoing rehabilitation, therapy, or assistive devices needed to aid in your recovery.


General Damages

General damages, also known as non-economic damages, address the intangible impacts of your injury that are not easily quantifiable in monetary terms. These damages acknowledge the broader effects of the injury on your life and well-being. Examples of general damages include:

Pain and Suffering: This compensation covers the physical pain and discomfort you have endured as a result of your injury. It also considers any ongoing pain that may persist in the future.

Emotional Distress: Injuries often come with emotional and psychological consequences, such as anxiety, depression, and trauma. General damages can include compensation for this emotional suffering.

Loss of Enjoyment of Life: If your injury prevents you from participating in activities or hobbies that you once enjoyed, you may be entitled to compensation for this loss of enjoyment.

Loss of Consortium: This refers to the impact of your injury on your relationship with your spouse or family members, including loss of companionship, affection, and support.

How Does the Trial Process Work?

The legal process for personal injury suits can be daunting. We’ve broken the process down into a few key steps:

Initial Consultation – During the initial consultation, you will meet with one of our lawyers. This consultation is crucial because it allows us to develop an understanding of your needs and to see if our firm is right for you. We do not accept cases unless we are sure that the client will benefit from our retainer.

File for Compensation – Once we have the facts of the case, the next step is to formally request for compensation from the insurance company. Prior to filing for compensation, we will obtain all documentation that we can, including medical records, statements from the accident and any other information that you can provide.

The insurance company will eventually return a response, which will include either denial of coverage in full or in part, or a settlement offer.

Negotiation – If the insurance company flatly denies coverage, the next step is likely trial. However, if they offer partial coverage then we may begin what is known as “pre-trial negotiation.” During this stage, we will meet multiple times with the insurance company to until they either provide what you agree is an acceptable sum or the company ultimately declines the amount of coverage that we request.

Trial – If we are unable to reach an agreement with the insurance company, we will prepare a legal case and deliver it at trial. Some of the many responsibilities undertaken by our firm are:

  1. Jury selection
  2. Gathering evidence, including evidence of the accident and medical tests and testimony
  3. Preparing arguments for the jury’s consideration
  4. Filing pre-trial motions to shut down the oppositions use of certain evidence and to resolve any legal issues

Post-Trial – Once the trial has completed (hopefully with a favorable outcome), we will take care of receiving and disbursing funds. Insurance companies can sometimes be slow (or forgetful) when it comes to providing payouts, so part of our responsibility is to make sure you receive your settlement.
