Georgia’s dram shop statute can apply to a commercial alcohol provider, and in limited circumstances to a social host, but liability exists only if the statute’s specific elements are proven.

Liability exists when the provider knowingly served alcohol to someone underage or noticeably intoxicated, and the provider knew that person would soon be driving. Each element has to be proved.

A social host may be liable only when the facts meet Georgia’s dram shop law. This includes proof that the host knowingly served alcohol to a minor or a noticeably intoxicated person and knew that person would soon be driving.

Because the effect of criminal-case tolling depends on the facts and procedural history, the filing deadline should not be calculated from the crash date alone. An attorney should review whether charges were filed, how long the prosecution remained pending, and whether any other rules affect the claim.

Additional deadlines may also apply. Claims involving a government entity may require written notice within a much shorter period, and fatal crashes may involve separate wrongful death and estate claims with different filing requirements.
